Contract However, placing the order and paying for your credit(s) does not constitute the commencement of a contract between both parties - this only occurs when we have formally accepted your order and payment. This formal acceptance of the order, and thus the commencement of the binding contract, usually takes place within 24 hours of payment being confirmed (if paying through PayPal, this is usually within 24 hours of PayPal confirming your payment to us; if paying by cheque, this is usually within 24 hours of the funds clearing into our account). Prior to the commencement of the binding contract, you will receive all necessary information relating to your order in an email invoice from Minis To Midis. We reserve the right to deny formal acceptance of an order, whether it has been paid for or not. In the case of a newly ordered credit, its validity, and thus its binding contract, begins from the date that the order is formally accepted, and lasts for one year. The expiration date of a renewed credit is one year from the previous expiry date, if the order is formally accepted on or before the previous expiry date. In this case, the contract begins at the time that the renewal takes effect - when the previous expiry date is reached - and lasts for one year. If the renewal order is formally accepted after the credit's previous expiry date, the credit's new expiry date will be set to one year after the date of formal acceptance. The contract would then begin from the date of formal acceptance, lasting for one year. A single credit can only be used to make a single vehicle advert live at any one time during the credit's validity. However, you may change the advert that the credit is used for at any time, either by submitting a new advert and choosing to use an existing credit, or by logging in to your account and requesting to take one advert down, and make another existing advert live. Your contract will be filed, and we can supply you with a copy if required. However, we recommend printing a copy of the contract at the time of your order from http://www.ministomidis.com/print_seller_terms.php (opens new window).
Cancellations and Refunds If your order has not been formally accepted within 30 days of it being placed, either due to our inability to fulfil your order, or because we have not received your confirmed payment, the order will be cancelled, and no contract will be formed. You will be notified of this by email. If your payment has been processed already, and we are unable to fulfil your order within 30 days from the time of the order, for whatever reason, you will receive a full refund, and the order will be cancelled. Minis To Midis reserves the right to terminate any contract without refund if it considers the content of any advert listing to be inappropriate.
General These terms will be governed by and in accordance with English law and subject to the exclusive jurisdiction of the English Courts. If you do not agree to these terms then you must choose I Decline at the bottom of the page.
Correspondence These terms supersede any and all prior agreements, arrangements, statements and understandings (published 24th June 2010). |
